Content of the contract
The prerequisite for using the services of the mountain railways is the purchase of a valid ticket. This entitles the holder to use the areas that are open at the time (cable car facilities, slopes, cross-country ski trails, ski touring park, etc.)
The custormer acknowledges that is his or her duty to comply with the FIS rules and to behave considerately towards other customers and the staff of cable cars, in particular not to endanger the physical safety of other persons.
Likewise the customer must follow the instructions of the cablecar staff, as these serve the safety of the customers and the orderliness of the cableway operation.

Ticket system
a) The tickets are issued on contactless data carrier (no deposit card). The data carriers are reusable and rechargable. You are welcome to return the data carriers to us at the cash desks or in the letterboxes provided for recycling.
b) At the time of purchase, the first name, the surname, date of birth and a photograph will be recorded by means of a digital camera.
c) This data carrier may not be transferred to third parties for their use.
d) Single rides for non-skiers are issued as a voucher with a QR code and must be scanned at the specially deignated reading stations.

Online purchase:
The customer’s online order requires the complete and correct entry of all mandatory fields in the booking window as well as the explicit acceptance of the GTC by means of application provided in the booking window. Incorrect information may lead to the withdrawal of the ticket without replacement and to exclusion from carriage. The customer is obliged to notify any changes to their contact details (name, rsidential address, e-mail address) without delay.

Suspension and disruption of operation, reduced operation:
Non-use of the ski pass due to bad weather, avalanche danger, disruption of facilities, closure of ski runs, unforeseen departure, etc. does not result in a claim for refund or extension. Use of the slopes is at your own risk.
Operating times are subject to change due to snow conditions.
We would like to kindly point out that the use of the season or annual ticket is subject to compliance with the legal requirements applicable at the time and which you must observe, that these requirements may change at any time and that this usage may therefore be restricted, reduced or not possible at all during certain periods.

Reduced tickets:
A photo ID is required to obtain a reduced ticket (children, youth and invalids) without exception. There are no further reductions on already reduced tickets.

Abuse, exchange and extension:
Checks are carried out contionously in the ski area. Upon request by the cable car staff, the ticket and any proof of a reduction must be shown. The ski passes are subject to an access control system with photo control. Photographs of guests are taken at the turnstiles on a case-by-case basis, which are randomly checked by our staff against the comparison photos. The photos are deletd after the expiry of the ski pass.
The ski passes are personal and non-transferable. Any misuse will result in immediate withdrawal and will be penalised with three times the ski passe price. In the case of misuse, the right is reserved – provided that the legal requirements are met – to file complaint.
Subsequent exchange for anther ski pass and extension or postponement of the period of validity is not possible.

Parking:
Parking in all our car parks is free of charge!

Slope rescue:
Slope rescue operations are charged by us and are to be paid in cash.

Refund in case of skiing accidents:
A refund is only possible in the event of ski accidents for ski passes valid for 2 days or more and does not apply to accompanying persons. The used days are deducted from the ski pass price. A medical certificate from a doctore in the region must be presented. A handling fee will be deducted.

Ski pass associations:
The individual servies to which the card entitles the holder are provided by independent entrepeneurs. The entrepeneur who sells the card acts for the other entprepeneurs only as their representative. Therefore, only the respective entrepeneur is obliged to provide the individual service and to pay damages in the event of any incidents. In the case of annual and season tickets, personal data will be stored until revoked.

Loss:
The lost lift pass will only be replaced on presentation of the blocking number (receipt) and on payment of a handling fee.

Choice of skiing days:
E.G. 6 in 7 means that you can ski 6 days within 7 days. the last day of validity is indicated on your ski pass.

Discounts and Agreements

  • Free Bambini ski pass: If accompanied by a parent kids born in 2015 or after ski for free. Valid only if all ski passes are bought together (not valid for annual tickets, combined tickets or already reduced tickets). A photo ID card is absolutely required! Please note that children under 1.20 m (height) are not allowed to use the cable cars alone.
  • Group discounts: reduced group rates are available for 20+ persons – send a written request for more detailed information to marketing@tirolgletscher.com
  • Half-day lift tickets: With ½ day lift tickets the turnstiles can be passed after 11.30 am or 1.00 pm. Sorry, there are no morning ski passes!
  • Kaunertal plus: Buying a multi-day lift ticket (valid from 2 days up) you are allowed to ski on 1 day at Kaunertal Glacier, Fendels OR Hochzeiger in the Fendels Ski Area. This offer is not valid during promotional weeks.
  • Skibus shuttle: Free use of local skibus shuttle buses for holders of a valid lift ticket.
  • Ski instructors: officially certified ski instructors with a valid photo ID plus the Annual IVSI or ISIA Badge receive a discounted lift pass (not valid for annual tickets, combined tickets or already reduced tickets).
  • Additional days the validity of ski passes for 5+ days can be extended once (without a break in-between) at a special price. This special rate is available only on the following day (one day after the expiry date) on presentation of the expired ski pass.
  • Disabled persons discounted lift pass for holders of a valid disabled pass (minimum of 60% disability grade); not valid for annual tickets or already reduced tickets.

Ski Pass Cash Desks and Opening Hours

  • Gletscherexpress cash desk: 08.00 am – 4. pm (in winter: daily, also on Sundays and public holidays / in summer: during operating times of the Gletscherexpress mountain lift)
  • Rifflseebahn cash desk: in winter – 8.00 am – 4.00 pm / in summer – daily 8.30 am – 4.30 pm

Payment options: Cash in €, Bankomat Card (Maestro) and Credit Card (Visa, MasterCard, American Express)

Price details subject to change. Errors and omissions excepted. All prices are inclusive of VAT. With purchasing a ski pass you accept the General Terms & Conditions – Place of jurisdiction is Innsbruck.

Compensation for damage and liability
In the event of loss or damage, the Company shall only be liable for intent or gross negligence. Liability for ordinary negligence and compensation for consequential damage and financial loss, loss of interest, and loss or damage arising from third-party claims against the Contracting Party is hereby excluded.

Any damages awarded for claims asserted against the Company for liability, regardless of the legal grounds for doing so, shall be limited to the sum of the Company’s liability insurance cover.

The Company shall not be liable for damage or injury to piste users or the Contracting Party as a result of other parties’ misconduct. Particularly careless and dangerous skiing/riding and failure to respect barricades or other instructions shall entitle the Company to refuse to transport the Contracting Party in question.

The Contracting Party’s obligations
The terms and conditions of transport displayed at all valley stations shall form an integral part of the terms and conditions of transport. They apply to the transport of people and behaviour in the lift areas. The Contracting Party undertakes to comply with all terms and conditions of transport. Breach of the terms and conditions of transport shall have legal consequences in terms of liability.

The Contracting Party shall follow all FIS rules.

Purchasing vouchers and tickets in the online shop/ticket shop “Catalate Commerce, Inc.”

Vouchers may be redeemed for the Company’s entire service range. It is not possible to exchange the vouchers for cash. Vouchers may only be redeemed at the Company’s ticket offices.

Lost vouchers will not be replaced.

If the value of a voucher exceeds that of the service purchased, a new voucher shall be generated for the remaining credit.

Vouchers have no expiry date.

The price for vouchers does not include VAT. A VAT invoice can only be generated in accordance with the Austrian VAT Act upon voucher redemption and performance of the purchased service. ost.

The Contracting Party shall provide all relevant, correct and complete information requested upon conclusion of the contract. In the event that the Contracting Party supplies the Company with incorrect, incomplete or unclear information, it shall indemnify the Company against all costs and damage incurred by the Company as a result.

The value of each voucher shall be equivalent to the sum paid for the voucher.

Choice of law and place of jurisdiction

For all contracts concluded between the mountain railway and its contractual partner and all claims arising from the legally effective existence or non-existence of these contracts, the application of substantive Austrian law is agreed to the exclusion of the provisions of Austrian private international law.

The exclusive place of jurisdiction for all legal disputes arising from a contract concluded or to be concluded between the mountain railway and its contractual partner on the basis of these terms and conditions shall be the court with subject-matter jurisdiction for A-6481 St. Leonhard. However, the mountain railway may also bring an action against the contractual partner at another domestic or foreign place of jurisdiction.

CANCELLATION INSTRUCTIONS

A customer who is a consumer within the meaning of the Consumer Protection Act has the right to cancel this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day on which the consumer or a nominated third party who is not the carrier takes possession of the items ordered;
OR (in the event that a contract is concluded regarding several goods that are ordered together but delivered separately , from the day in which the consumer or a nominated third party who is not the carrier takes possession of the last item ordered;
OR (in the event that a contract is concluded regarding one item sent over several part deliveries or in pieces) from the day that the consumer or a nominated third party who is not the carrier takes possession of the last part delivery or piece of the item.

If the consumer exercises their right to cancel within the appropriate period, their order shall no longer be binding. The date for exercising the right to cancel shall be the date on which the rescission notice or ordered items are sent back to the Company.

A clear statement (e.g. by registered mail, fax or e-mail) regarding their decision to cancel this contract. The consumer may use the cancellation form provided below, but this is not obligatory.
To observe the cancellation period, it suffices to send the Company notification that the right to cancel will be exercised before the cancellation period expires.

However, the right to cancel shall not exist if performance of the service concerned has already begun within the cancellation period. In addition, the purchase of season tickets or ski passes for a specific period of time shall not be subject to the right to cancel under Section 18(1) No. 10 of the Distance Selling Act.

Consequences of cancellation
If this contract is cancelled, the Company shall immediately reimburse all payments made to it by the consumer, including all delivery costs, no later than 14 days from the date on which it receives notification that the consumer wishes to exercise their right to cancel. The Company shall refund any money owed to the consumer using the same payment method used in the original transaction, unless expressly agreed otherwise with the consumer. The consumer shall under no circumstances be charged a fee for this refund. The Company shall be entitled to withhold the refund until it has received the returned goods or the consumer has provided evidence that the goods have been returned, whichever is earlier.
The consumer shall return the goods to the Company immediately and no later than 14 days from the day on which they informed the Company of their desire to cancel the contract. The cancellation period shall be deemed to be observed if the consumer sends the goods back to the Company before this 14-day period expires. The consumer shall bear all costs directly arising from the return of the goods. The consumer shall pay the Company appropriate compensation for use of the product, including compensation for any associated loss in value.

For all contracts concluded between the Company and the Contracting Party and for all claims arising from the legally valid existence or non-existence of this contract, it is hereby agreed that substantive Austrian law shall apply, excluding the provisions of Austrian private international law.

The exclusive place of jurisdiction for all legal disputes arising from this or future contracts between the Company and the Contracting Party shall be the court with jurisdiction rationed loci (A-6481 St.Leonhard) and rationed materiae. However, the Company may also pursue legal action against the Contracting Party in another domestic or foreign place of jurisdiction.
The Contracting Party hereby notes that a reference photo shall be taken of the Ticket holder on their first use of a camera-equipped turnstile. This reference photo shall be compared by lift staff to each additional photo taken at camera-equipped turnstiles. This data application (Photo Compare) has been registered with the data protection authority and is entered in the data processing register.

The reference photo shall be immediately deleted upon expiry of the Ticket. The other, additional photos shall be deleted no later than 30 minutes after the Ticket holder uses the turnstile in question.
